1. Definitions
In these terms and conditions:
- "We", "us", "our" refers to Custom Choice Home Improvements, Fengate, Peterborough, PE1 5QP.
- "You", "your" refers to the customer entering into a contract with us.
- "Products" refers to windows, doors, conservatories and any other goods or materials we supply.
- "Services" refers to the survey, supply, delivery and installation of products.
- "Contract" refers to the agreement between you and us formed upon your acceptance of our quotation.
2. Quotations & Acceptance
- All quotations are provided free of charge and without obligation.
- Quotations are valid for 30 days from the date of issue unless otherwise stated in writing.
- A quotation becomes a binding contract once you have signed and returned the acceptance form or confirmed acceptance in writing (including by email) and any required deposit has been received.
- Prices quoted are inclusive of VAT at the current rate unless expressly stated otherwise.
- We reserve the right to amend a quotation if the scope of work changes following a detailed survey or if there are changes in material costs beyond our control.
3. Surveys & Measurements
- A detailed technical survey will be carried out at your property before any order is placed with our suppliers.
- You must ensure that we have clear and safe access to all areas where work is to be carried out.
- The final specification and measurements taken during the survey will supersede any preliminary measurements taken during the initial quotation visit.
- If the survey reveals additional work or variations not covered in the original quotation, we will advise you of any revised costs before proceeding.
4. Pricing & Payment Terms
- A deposit may be required upon acceptance of the quotation. The amount will be clearly stated on your contract.
- The balance of payment is due upon satisfactory completion of the installation unless alternative payment terms have been agreed in writing.
- We accept payment by bank transfer, debit card, credit card and cheque. Finance options may be available subject to status.
- If payment is not received within 14 days of the due date, we reserve the right to charge interest at 4% above the Bank of England base rate on the outstanding amount.
- Products remain our property until full payment has been received.
5. Installation & Delivery
- We will agree an installation date with you and endeavour to complete the work within the estimated timeframe.
- Installation dates are estimated and not guaranteed. We will notify you as soon as reasonably practicable of any delays.
- You must ensure adequate access to the property and that the working area is clear of furniture, ornaments and other obstacles before the installation begins.
- We will take reasonable care to minimise disruption and will leave the work area clean and tidy upon completion.
- Any existing windows, doors or materials removed during installation will be taken away by us unless you request otherwise.
- Minor making good (e.g. plastering around window frames) is included as standard unless otherwise stated. Redecorating is the customer's responsibility.
6. Guarantees & Warranties
- All products supplied and installed by Custom Choice Home Improvements come with a 10-year guarantee covering manufacturing defects and installation workmanship.
- The guarantee commences from the date of completed installation.
- The guarantee does not cover damage caused by misuse, accidental damage, failure to maintain products in accordance with our care instructions, or unauthorised modifications.
- Glass units are additionally covered by a separate manufacturer's guarantee against sealed unit failure.
- Guarantees are not transferable to subsequent property owners unless we agree in writing.
- Our guarantees do not affect your statutory rights.
7. Cancellation Rights
- Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your contract within 14 days from the date the contract is formed without giving any reason.
- To exercise your right to cancel, you must inform us of your decision by a clear statement, for example by letter or email to the contact details provided in Section 12.
- If you cancel within the 14-day cooling-off period, we will reimburse all payments received from you without undue delay and no later than 14 days after the day on which we are informed of your decision to cancel.
- If you have requested that work begins during the cancellation period, you will be liable to pay us an amount proportionate to the work carried out up to the point you notified us of your cancellation.
- Bespoke or made-to-measure products that have already been manufactured to your specification may not be eligible for a full refund after the cooling-off period.
8. Complaints Procedure
- If you are dissatisfied with any aspect of our products or services, please contact us as soon as possible using the details in Section 12.
- We will acknowledge your complaint within 3 working days and aim to provide a full response within 14 working days.
- Where a complaint relates to installation workmanship, we will arrange an inspection at a mutually convenient time and carry out any necessary remedial work at no additional cost to you.
- If you remain dissatisfied following our response, you may refer the matter to an alternative dispute resolution provider or take legal action.
9. Liability
- We accept liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.
- Subject to the above, our total liability under or in connection with the contract shall not exceed the total price paid by you for the products and services.
- We shall not be liable for any indirect or consequential loss, including but not limited to loss of profit, loss of business, loss of goodwill or loss of data.
- Nothing in these terms shall affect your statutory rights as a consumer.
10. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Acts of God, flood, earthquake or other natural disaster
- Epidemic or pandemic
- Government actions, sanctions, embargoes or trade restrictions
- Strikes, lockouts or other industrial action
- Shortage of materials or supply chain disruption
- Power failure or breakdown of equipment
In such circumstances, we will notify you as soon as reasonably practicable and will use reasonable endeavours to mitigate the effects of the delay.
11. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
